PCO judges will have majority after Judges’ restoration: Constitutional experts
LAHORE: Constitutional experts say that after maintaining the PCO judges at their positions and restoring the deposed judges, a clear division would be seen in the figurative majority of the judges in the Supreme Court and the high courts and the judges taking oath under PCO would be in majority. As per the constitutional experts, 13 judges in the Supreme Court were deposed on November 3. These judges included Justice Rana Bhagwan Das, who retired in December 2007, after which the number of the deposed judges has become 12. After November 3, 2007, 16 judges were appointed in the Supreme Court while the number of the appointed judges in the Supreme Court is 17. In case of reinstatement of the 12 deposed judges, the number of the Supreme Court judges will become 28 and the judges taking oath under the PCO will figuratively have an edge over the deposed judges. Same situation will be seen in the Lahore and the Sindh High Courts. Similarly, the present seniority structure of the Supreme and the high court judges, appointed after November 3 will be ended after the reinstatement of the deposed judges.
